Based on cost-of-living, the U.S. Department of Labor has announced changes to OSHA civil penalty amounts in 2024.
In 2015, Congress enacted the Federal Civil Penalties Inflation Adjustment Act Improvements Act to enhance the effectiveness of civil monetary penalties.
Under the act, agencies, including OSHA, are mandated to publish "catch-up" rules and adjust annually for inflation, reinforcing the financial consequences of violations.
This new change went into effect on January 16, 2024, due to the holiday celebrated yesterday, Martin Luther King Jr. Day.
Penalty Increases
Serious and Other-Than-Serious Violations:
Current: $15,625 per violation
New 2024: $16,131 per violation
Willful or Repeated Violations:
Current: $156,259 per violation
New 2024: $161,323 per violation
